Terms & Conditions of The Manly-Manado Walk |
Participant Agreement
I agree to the following as condition of participating in the The Manly-Manado Walk 12 ("Event").
I acknowledge that:
1. I participate in the Event at my own risk. I will take all reasonable measures to protect myself from the risks of participation. I accept all responsibility for travel and medical insurance and for payment and/or reimbursement of medical/surgical expenses incurred on my behalf.
2. I am responsible for all property I bring to the Event sites and that Seaforth Baptist Church (event organiser) accepts no responsibility for any loss or damage to this property except as permitted by law.
3. I undertake to comply with all applicable regulations, by laws and rules of The Manly-Manado Walk 12 and Seaforth Baptist Church in relation to the Event and will comply with all reasonable directions and decisions of the officials.
4. I release Seaforth Baptist Church (and its directors, officers, employees, volunteers, contractors, sponsors and/or agents) from any claim and from any liability (to the extent permitted by law) for or as a result of any loss, injury or damage suffered by me in relation to my attendance and participation at the Event, how so ever caused, including any claim or liability which arises due to any negligence of Seaforth Baptist Church (and/or their directors, officers, employees, volunteers, contractors, sponsors and/or agents).
5. To the best of my knowledge, I am not suffering from a condition which would prevent and/or render me unfit to participate in the Event.
6. I understand that an event photographer will be taking photographs of participants on the walk. I agree for photographs of myself participating in the walk to be distributed and published for the purpose of event publicity. I agree for my photograph participating in the walk to be published including but not limited to Facebook, the GoFundraise fundraising website, the Compassion Australia website and the Seaforth Baptist Church website. I understand that by entering into this participation agreement, I consent to my photograph being taken and published.
7. I being the participant, have read and agreed to these terms and conditions. I understand that by supplying GoFundraise, Compassion Australia, The Manly-Manado Walk 12 or Seaforth Baptist Church with my e-mail address I will receive regular updates from the Event Organisers in order to keep me informed about the Event.
8. I acknowledge that this Agreement is governed by the laws of New South Wales and the Courts of which have exclusive jurisdiction.
9. If any part of this Agreement is determined to be unenforceable, all other parts shall be given full force and effect.
10. I have read this Agreement and agree to it freely and voluntarily without any inducement or/duress
11. I am over 18 years old or I certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the releases, and, for myself, my heirs, assigns, and next of kin, I release and agree to identify the releases from any and all liabilities to the minor child's involvement, participation, or observance of programs as provided above, even if arising from their negligence.

These Terms must be read together with any Terms and Conditions specific to a particular event (Event Terms) which are located on the fundraising page for that event. If there is any conflict between these Terms and any Event Terms, then these Terms will prevail to the extent of the inconsistency.
